The residents at the Little Farm trailer park in the Village of El Portal do not have to move out just yet.
Wealthy Delight LLC, the new owners of the property, gave residents a February deadline to move out. The land is going to be redeveloped for a yet-to-be-determined project.
Residents recently found out that the February deadline had been extended for three months as a result of a pending lawsuit.
The lawsuit alleges the Village of El Portal did not comply with state law when it took official action to close the park by signing a settlement agreement with Wealthy Delight.
In January, an appeals court cleared the way for the lawsuit to move forward. The court found that the village did not conduct a housing analysis before taking action that would lead to the relocation of the mobile home residents.
Howard Kuker, an attorney representing Wealthy Delight, said the three months will be spent in mediation to see if a trial can be avoided.
“There are advantage to both sides for the stay,” he said. “To me, it’s well worth waiting the 90 days.”
In the meantime, evictions for nonpayment and not following park rules will continue. The stay only applies to residents in good standing, Kuker said.
